(1) These terms apply to all contracts for the purchase of original works and prints between Kai Krause, Coquistraße 14, 39104 Magdeburg, Germany, hello@krausekai.de ("I"), and my customers ("you").(2) A consumer is any natural person who makes the purchase for purposes that are predominantly outside their trade, business or profession (§ 13 BGB).(3) Any deviating terms of the customer only apply if I expressly agree to them.
(1) The presentation of works on krausekai.de is not a binding offer but an invitation to send me an enquiry. (2) In response to your enquiry, I will send you a binding offer by email stating the work, final price, shipping costs and delivery method. I am bound by this offer for 7 days. (3) The contract is concluded when you accept the offer by email within this period. Together with the offer you will receive these terms and the cancellation policy. (4) The language of the contract is German; on request, I am happy to correspond in English. I store the contract text (offer and acceptance), and you receive it by email. (5) Every original is unique. Until an offer is accepted, a work may also be sold to other interested parties; if this happens, I will let you know immediately.
(1) By arrangement, I will bring a work to you for a few days so you can see it in your space. Duration, distance and any costs are agreed in advance by email. (2) The work remains my property during the trial period. Please handle it with care and protect it from direct sunlight, moisture and heat. You are liable for damage caused intentionally or negligently in accordance with statutory provisions. (3) If you decide to keep the work, we conclude a purchase contract under § 2. In this case, too, you have the statutory right of withdrawal as a consumer.(4) If you decide against it, I will collect the work. You will only incur further costs if we have agreed them in advance.
(1) All prices are final prices in euros. They include statutory VAT. (2) Packaging and shipping costs are added. They depend on the size of the work and the destination and are shown separately in the offer. They do not apply if you collect the work in Magdeburg. (3) For deliveries outside the EU, customs duties, import taxes and fees may apply. These are borne by you.
(1) You can pay by bank transfer or PayPal. (2) The purchase price is due on acceptance of the offer and must be paid within 7 days. The work is reserved for you from the conclusion of the contract and will be shipped or made ready for collection once payment has been received. (3) For collection, payment on site can be arranged.
(1) I deliver within Germany in 3–5 working days and within the EU in 5–7 working days after receipt of payment. Deliveries outside the EU by arrangement. (2) Works are shipped on their stretcher frame or in a shadow gap frame. If this is not possible for a destination, the canvas is taken off the stretcher and shipped rolled, after prior agreement. (3) By arrangement, you can collect your work from my studio at duk Galerie in Magdeburg.
The work remains my property until paid in full.
(1) If you are a consumer, I bear the risk of the work being damaged or lost in transit until it has been handed over to you. (2) Please check the parcel on arrival and report any obvious transport damage to the carrier and to me as soon as possible (photos welcome). This helps me enforce claims against the carrier. Your statutory rights remain unaffected.
Consumers have a right of withdrawal as set out in the cancellation policy (see krausekai.de/en/widerruf).
(1) Statutory warranty rights apply. (2) My works are hand-painted originals. Colours may look different on screens and in photos; such differences and features typical of the work, such as brushstrokes, paint runs, charcoal marks or irregularities of the support, are not defects.
(1) I am liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. (2) In cases of slight negligence, I am only liable for breach of an essential contractual obligation (one whose fulfilment makes the contract possible in the first place and on which you may rely), limited to the foreseeable damage typical for this type of contract.
By purchasing, you acquire ownership of the original. Copyright and all rights of use – in particular the right to reproduce the work, e.g. as a print, postcard or for commercial purposes – remain with me. Photos of the work in your home for private use and social media (feel free to tag @kaikrause_art) are of course permitted.
I am neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected. (2) If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Magdeburg. (3) Should any provision be invalid, the remainder of the contract shall remain valid.
